Guardianship of a child in Oklahoma grants rights to the guardian that are very similar to having parental rights of the child. Legal guardianship empowers the guardian to make the legal decisions for the child regarding education, health care, religion, and his/her general welfare. All of the decisions financial decisions regarding the child's assets, if there are any, are subject to court review and approval.
Guardianship of an adult is the appointment of a competent adult to manage the legal, financial, and/or health care needs. Oklahoma courts can grant the guardian powers necessary to care for the needs of the incapacitated adult. They will use a test called "least restrictive measures" to determine what powers should be given a guardian. Courts can order guardianships for an adult that is incapacitated due to: mental illness, demetia, retardation or developmental disability, physical illness/disability, or drug or alcohol dependency. If the adult is not totally incompetent or incapacitated, a conservatorship or limited guardianship may still be appropriate.
